Every employee can ask “why?”
Employees must be able to see how pay is set and how it develops, and can ask how their pay compares with colleagues doing work of equal value.
Employers make easily accessible the criteria used to set pay, pay levels and pay progression. The criteria must be objective and gender-neutral.
Member states may exempt employers with fewer than 50 workers from the progression part.
- Employees may request their own pay level and the average pay levels, by sex, for workers doing the same work or work of equal value.
- The employer answers within two months.
- Employers remind all staff of this right every year.
- Clauses that forbid employees from disclosing their pay are void.
Only averages are disclosed, never an individual colleague's pay.
Member states may route information for very small comparator groups through worker representatives or equality bodies.
Every progression rule must answer “Why does my colleague earn more?” in one sentence.
