Rights & obligations · Reporting · Art. 9, 10

Report the gap. Explain it or fix it.

Employers above the thresholds report defined gap metrics. If a gap cannot be justified, the next step is a joint pay assessment.

Art. 9

What the report contains

Art. 9 · EUR-Lex

  • The gender pay gap, mean and median.
  • The gap in variable and complementary components, mean and median.
  • The share of women and men receiving variable components.
  • The share of women and men in each pay quartile.
  • The gap by category of workers, broken down by base pay and variable components.

Art. 10

When a joint pay assessment is triggered

Art. 10 · EUR-Lex

A joint pay assessment with worker representatives is required when three conditions hold: the gap in any category of workers is at least 5%, it is not justified by objective, gender-neutral criteria, and it has not been remedied within six months of the report.
